위험사회로부터 학교안전의 확보에 대한 법·정책적 방안
우리 사회는 인구의 증가와 산업의 발달, 통신과 문화의 발달로 인하여 복잡한 사회가 되었다. 이러한 복잡한 사회는 여러 가지 편리함을 갖추기도 했지만 반대로 위험사회로 진입하게 되었다. 울리히백은 현대사회를 위험사회라고 주장하였다. 실제로 우리 사회를 돌아보면 많은 위험으로부터 사고가 발생하였고, 우리는 위험사회 속에서 안전을 위협받으며 살아가고 있다.
학교는 흔히 작은 사회라고 한다. 학교는 국가의 미래를 이끌어갈 학생들이 교육을 받는 장소이다. 이러한 학교도 사회의 위험으로부터 안전하지 못하다. 학교의 안전을 위협하는 요소로는 학교폭력, 전염병, 부실·불량급식, 교외 단체활동 중 위험, 교통사고 등의 우리 학생들의 생명, 건강을 위협하는 위험 등이 있다. 학생들은 안전하게 학교에서 교육을 받을 권리를 국가로부터 보장받고 있다. 그럼에도 불구하고 현재 국가에서 실시하고 있는 학교의 안전확보를 위한 법·정책적 대처가 미비하거나 실효적이지 못하고 있는 것으로 판단된다.
이에 본 논문은 학교안전에 대한 확보를 위하여 학교안전개념에 대한 이론적 정립과 학교안전과 관련한 법체계를 고찰한 후 학교 안전권 확보를 위한 법·정책적 문제점과 해결방안을 제시하고자 한다.
The modern society has become complex followed by population increase and the development of industry, communication and culture. A complex society has many benefits as well as risk factors. Ulrich Beck defined the modern society as a risk society. Looking back on our society, there have been many accidents caused by the risks and our safety is being threatened living in the risk society.
A school is often called a small society. A school is a place where students receive education who will be leading the future of a country. Schools are not safe from the risk of the society. The factors that threaten the safety in schools include school violence, infectious diseases, poor·low quality school meals, accidents during extracurricular activities, car accidents, etc. All these risk factors threaten the students’ lives and health. Students’ rights to be educated in a safe environment are protected by the government. Even so, the current governmental legislations and policies aimed to ensure school safety are insufficient and ineffective.
In this sense, the current paper intends to establish the theoretical background for the concept of school safety, examine the legal system regarding school safety and suggest legal·policy problems and solutions to ensure safety rights in schools.
